On September 26, ESMA launched a consultation on delegated acts required by the UCITS V Directive.

Following the adoption by the European Parliament of the UCITS V Directive text, ESMA received a provisional request for technical advice from the European Commission regarding certain delegated acts foreseen by the UCITS V Directive provisions. Feedback will have to be provided to the European Commission by the end of November.

ESMA also published a consultation paper on two topics for which its advice was required - the insolvency protection of UCITS assets when delegating safekeeping and the independence requirement for the management company/investment company and the depositary - in which it outlines its proposed measures and arrangements to be carried out by depositaries and third parties.

All comments should be sent by 24 October 2014 and submitted by means of the response form provided on the ESMA’s website.
